2. Products
All Magisa Art jewellery is designed and handmade by the creator using selected materials and components.
Each product is presented on the website with a description of its main characteristics, including, where relevant, the materials used, dimensions and other useful information.
As each piece is handmade, minor variations in colour, texture, shape or finish may occur. These variations are inherent to handmade production and are not considered defects when they do not affect the essential characteristics or functionality of the product.
3. Product Availability
Products offered on the Magisa Art website may be available in different ways.
Some pieces are one-of-a-kind creations and cannot be reproduced once sold.
Other designs may be recreated after an order has been placed, depending on the availability of materials and the creator's ability to reproduce the design. Recreated pieces may show minor variations from the original piece due to the handmade nature of the creation and the materials used.
Where relevant, the product listing may indicate whether a piece is one of a kind or may be recreated.
The availability of materials may occasionally affect the ability to reproduce a particular design. If an ordered product cannot be produced or supplied, Magisa Art will contact the customer and provide the applicable options in accordance with the customer's statutory rights.
4. Prices
All prices displayed on the website are stated in euros unless otherwise indicated.
Prices may be changed at any time. However, the price applicable to an order is the price displayed at the time the order is placed.
Any applicable delivery charges will be displayed before the customer completes the order.
5. Orders
To place an order, the customer selects the desired products, adds them to the shopping cart and completes the checkout process.
Before payment is confirmed, the customer can review the contents of the order and correct any errors.
An order becomes binding once the payment has been successfully completed and the order confirmation has been sent.
The customer is responsible for ensuring that the information provided during checkout, particularly the delivery address and email address, is accurate.
6. Order Confirmation
After placing an order, the customer will receive an order confirmation by email.
The confirmation will contain relevant information about the order.
Customers should retain the confirmation email for their records.
7. Payment
Payment is currently available by credit or debit card through the payment services provided on the website.
Payment must be made in full at the time the order is placed.
Magisa Art does not intentionally store complete payment card details.
Payment processing may be carried out by third-party payment providers integrated with Wix.
8. Handmade Production and Preparation
Products are handmade individually.
Orders are generally prepared for dispatch within 7–15 business days (might take more time for one-of-a-kind pieces).
This preparation period may be extended during announced periods of holidays or exceptional closure.
Where a significant delay is expected, Magisa Art will endeavour to inform the customer.
The preparation period refers to the time required to prepare and dispatch the order and should not be confused with the carrier's delivery time.
9. Shipping
Magisa Art currently intends to offer worldwide shipping (except for USA).
Available destinations, delivery methods and shipping costs will be displayed during checkout.
Shipping carriers: La Poste (in France) and Colissimo for others
Estimated delivery times: 2 business days (in France) and approximately 3-4 business days within most European destinations.
The customer is responsible for providing a complete and accurate delivery address.
Magisa Art cannot be held responsible for delays caused by incorrect or incomplete delivery information provided by the customer.
For international orders, the customer may be responsible for customs duties, import taxes or other charges imposed by the destination country.
10. Delivery Problems
If a parcel appears to be damaged upon delivery, the customer should report the issue to Magisa Art as soon as possible and, where appropriate, retain evidence of the condition of the parcel.
If an order appears to be lost, delayed or incorrectly delivered, the customer should contact:
magisa.art.pro@gmail.com
Magisa Art will investigate the issue with the relevant delivery provider where appropriate.
11. Right of Withdrawal
In accordance with applicable consumer protection law, consumers generally have a 14-day withdrawal period for distance purchases.
For the purchase of goods, this period begins on the day the customer, or a third party designated by the customer other than the carrier, receives the goods.
The customer does not have to provide a reason for exercising the right of withdrawal.
To exercise this right, the customer must clearly inform Magisa Art of their decision to withdraw before the end of the applicable withdrawal period.
Withdrawal requests should be sent to:
magisa.art.pro@gmail.com
The customer may use the following wording:
"I hereby inform you that I wish to withdraw from my purchase contract for the following product(s): [PRODUCT NAME]. Order number: [ORDER NUMBER]. Date of order: [DATE]. Date received: [DATE]. Name: [CUSTOMER NAME]."
12. Returning Products
After notifying Magisa Art of the withdrawal, the customer must return the relevant product without undue delay and, in principle, within 14 days.
Products should be returned:
-
In their original packaging where reasonably possible
-
With the original labels attached
-
In an unused and undamaged condition
-
With all included components and accessories
The customer is responsible for taking reasonable care of the product while it is in their possession.
Return address: 11 rue de l'hôpital 21000 Dijon
Return shipping costs are borne by the customer unless applicable law provides otherwise or Magisa Art expressly agrees to cover them.
13. Refunds
Where a valid right of withdrawal is exercised, Magisa Art will refund the payments received from the customer, including the applicable standard initial delivery costs.
The refund will generally be made using the same payment method used for the original transaction, unless otherwise agreed with the customer.
Magisa Art may delay the refund until the returned goods have been received or the customer has provided evidence that the goods have been sent back, whichever occurs first, where permitted by applicable law.
Where the customer expressly selected a more expensive delivery method than the standard delivery option offered, the additional cost may not be refundable to the extent permitted by law.
14. Exceptions to the Right of Withdrawal
The legal right of withdrawal may not apply in certain circumstances defined by law.
For example, exceptions may apply to certain goods that are made according to the consumer's specifications or clearly personalised.
Any applicable statutory exception will be communicated to the customer before the purchase where required.
15. Exchanges
Magisa Art does not offer exchanges.
If you wish to purchase a different item, you must return the original item in accordance with the applicable right of withdrawal and place a new order separately.
Return shipping costs are the customer's responsibility.
